1. The Prize
1.1 You could win a Volkswagen ("VW") California Campervan in this prize draw (a California Ocean SWB 150 PS 2.0 TDI 7sp DSG specification, in cherry red with 17"x 7J ‘Aracju' Silver alloy wheels and ‘Palladium' interior) (the "Prize").
1.2 Only one Prize is available in total, and is subject at all times to availability.
2. Promoters Name & Address
2.1 The promoter of the prize draw is of address (the "AA").
3. How to Participate in the Prize Draw
3.1 In order to enter this prize draw you must purchase a new AA breakdown membership online (via AA.com or any of the following approved Network Digital websites: healthservicediscounts.com, discountsforteachers.co.uk, discountsforcarers.com or charityworkerdiscounts.com), and the main account holder will automatically be entered into the prize draw
3.2. You may only enter this prize draw a maximum of one time.
3.3 By entering this prize draw you accept these terms and conditions. To opt out of this prize draw, the main account holder must email [email protected] with the subject line, ‘Opt out of VW California Campervan Prize Draw' and include within this email, your name as it appears on your breakdown policy and your membership number.
4. Applicable Dates
4.1 This free prize draw will start at 00:01 on 6 June 2023 and, subject to Clause 9.2, the closing date and time for the free prize draw will be at 23:59 on 31 July 2023.
5. Eligibility
5.1 The prize draw is only open to residents of the UK who are aged 17 and over who remain active AA members when the Prize winner is selected.
5.2 The winner must have an active AA Membership 15 days after the purchase of the eligible products identified in Clause 3.1 of these terms.
5.3 The following are not eligible to enter or win this prize draw:
5.3.1. employees of the AA or its holding subsidiary companies;
5.3.2 employees of agents or suppliers of the AA or its holding companies, who are professionally connected with the competition or its administration;
5.3.3 members of the immediate families of those identified in 5.3.1, 5.3.2 and 5.3.3 above; and
5.3.4 policies purchased via AA Warranties, AA Loans, AA Driving School or via an AA partner (excluding purchases made via the Network Digital websites listed in Clause 3.1 of these terms);
5.4 Entries which are (as applicable): received after the closing date and time, incomplete or are otherwise not in accordance with these terms and conditions and/ or the instructions given by the AA, will not be counted and will be excluded.
5.5 AA accepts no responsibility for entries not successfully completed or submitted due to a technical fault (such as a technical malfunction, computer hardware or software failure, satellite, network or server failure) of any kind and/or where applicable. If for any reason a technical interruption, fault or site failure occurs when purchasing online, the AA does not take any responsibility for incomplete purchases and any incomplete purchases will not be considered valid for entry into the prize draw. Where applicable the AA accepts no responsibility for any purchases which are not completed for any reason.
6. Selection of the Winner
6.1 The winner will be selected at random from all the eligible entries received. This will be done by an automated process or a process which will be conducted or supervised by an independent person.
6.2 The winner will be notified by phone (using the contact details of the main account holder linked to the eligible AA breakdown membership) by no later than 15 August 2023 to inform them of their Prize.
6.3 The Prize may not be claimed by a third party on your behalf. The AA does not accept any responsibility if you are not able to claim the Prize.
6.4 The Prize is awarded conditionally upon acceptance and if a winner is unable to be contacted after 5 days of the AA attempting to notify the winner under Clause 6.2 above or if any prize is unclaimed / declined within 10 days after being notified under Clause 6.2 above the Prize shall be deemed as unclaimed or unaccepted and a supplementary winner may be drawn at the AA's discretion.
6.5 Following the notification of the winner in accordance with Clause 6.2 of these terms, the winner's name and contact details will be provided to VW to facilitate the delivery of the Prize (delivery of the Prize will either be made by VW or the AA, but the final delivery arrangements will be confirmed with you in advance). The AA is not responsible for the Prize not being received, and delivery of the Prize is subject at all times to availability and the delivery timescales of VW.
6.6 The AA retains the right to substitute the Prize with another prize of similar value in the event the original prize offered is not available.
6.7 The Prize is not negotiable, exchangeable or transferable for any other product, service or a cash alternative.
6.8 The decision of the AA is final. No correspondence will be entered into regarding the outcome.
7. Limitation of liability
7.1 In so far as is permitted by law, the AA its agent or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by the negligence of the promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
7.2 Under no circumstances will the AA's aggregate liability to you for any and all claims arising under these terms and conditions and/or the prize draw which do not fall within clause 7.1 above exceed £200.00.
8. Data Protection & Publicity
8.1 The winner may be asked to take part in future publicity.
8.2 The AA and VW will use your personal data for the purpose of the management of the prize draw and the provision of the Prize, including to assess your eligibility for the prize draw and to administer the competition. 8.3 The AA must either publish or make available information that indicates that a valid award took place. We are required to make the forename, surname and the country of the winner available upon request.
8.4 If you object to any or all of your surname, country and winning entry being published or made available, please contact the AA at [email protected]. In such circumstances, the AA must still provide the information and winning entry to the Advertising Standards Authority on request.
9. General
9.1 If there is any reason to believe that there has been a breach of these terms and conditions, the AA may, at its sole discretion, reserve the right to exclude you from participating in the prize draw.
9.2 The AA reserves the right to hold void, suspend, cancel or amend the prize draw where it has become necessary to do so for any reason.
9.3 These terms and conditions constitute the entire agreement between you and the AA and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between us, whether written or oral, relating to its subject matter.
9.4 These terms and conditions (and any issues or disputes arising) shall be governed by English Law, and the AA and entrants to the prize draw submit to the exclusive jurisdiction of the English courts.
