AA driving school pupils

Your instructor

Your instructor is a self-employed franchisee (Your Instructor) of Automobile Association Developments Limited (the AA driving school).

Lessons

The contract for driving tuition is solely between You and Your Instructor. You and Your Instructor are responsible for agreeing all matters relating to the timing, location and duration of individual lessons.

You must notify Your Instructor of any matters which affect your ability or entitlement to have driving tuition, for example, but not limited to, any lack, or loss, of a valid provisional driving licence.

AA The Driving School Agency Limited acts as agent for Your Instructor in receiving Your payments for driving tuition, other than payments made directly by You to Your Instructor. Where AA driving school and/or AA The Driving School Agency Limited makes bookings with, or supplies any information or documentation to You, or processes any payments for Your lessons, they act as the agent of Your Instructor.

Cancellations

If You or Your Instructor wish to cancel a lesson a minimum of 48 hours prior notice should be given. Cancellations must be made directly between You and Your Instructor.

If you do not give at least 48 hours notice of cancellation, Your Instructor will be entitled to charge for the lesson(s) concerned.

Payments and lesson bookings

You must pay for tuition in advance by using one of the following methods:

  • Payment by credit or debit card online at www.AAdrivingschool.co.uk
  • Payment by credit or debit card by telephoning the AA driving school Customer Service Centre
  • Payment by cash, cheque or credit/debit card direct to your AA Instructor. (Any cheques must be made payable to Your Instructor. Your instructor will confirm whether or not they are able to take payments via credit or debit card).

AA driving school has no responsibility or liability to You for payments made by other means and further if you do pay Your Instructor directly by cash, cheque or card payment, You should obtain a receipt. AA driving school accepts no responsibility for any payments made direct to Instructors.

Price changes

The price of lessons which have not been pre-paid as part of a block booking may be changed at any time. You will always receive prior notice of such changes.

The cost of prepaid tuition is based on the lesson price in force at time of booking and will be honoured for 12 months thereafter irrespective of any price increase that may occur between the date of booking and when the lessons are taken. Any unused lessons remaining after 12 months have elapsed shall have any lesson price increase applied.

Transferability of lessons

You cannot sell or transfer lessons which have been purchased in Your name to any other person without consent.

Liability

Your Instructor, AA driving school and/or AA The Driving School Agency Limited are not liable to You for any loss or damage caused where, and to the extent that:

  • there is no breach of a legal duty owed to You by the relevant person or body;
  • such loss or damage is not a reasonably foreseeable result of such a breach;
  • any such loss or damage, or increase in the same, results from any breach or omission by You;
  • any such loss or damage results from circumstances or matters outside of the reasonable control of the relevant person or body

Your Instructor, AA driving school and/or AA The Driving School Agency Limited shall not, in any event, be liable for losses relating to any business interests You may have including, without limitation, lost profits, loss of opportunity or business or business interruption.

You are reminded that neither AA driving school and/or AA The Driving School Agency Limited are parties to the contract for driving tuition itself, which is between You and Your Instructor. This does not affect any liability that AA driving school and/or AA The Driving School Agency Limited may have for any loss or damage You may incur which is caused directly as a result of any breach (including negligence) by it or them of any legal duty owed by it or them to You.

Nothing in these Terms and Conditions will affect any statutory rights You may have as a consumer.

Law applying to terms and conditions

These Terms and Conditions are governed by the laws of England and Wales.

Use of personal information

Information you provide or we hold about you (whether or not under our contract (or contracts) with you) may be used by us or our agents to:

  1. identify you when you contact us;
  2. help identify accounts, services and/or products which you could have from us from time to time. We may do this by automatic means using a scoring system, which uses the information you have provided, any information we hold about you and information from third party agencies (including credit reference agencies).
  3. help administer, and contact you about improved administration of, any accounts, services and products we have provided before, or provide now or in the future;
  4. carry out marketing analysis and customer profiling (including with transactional information) and create statistical and testing information;
  5. help to prevent and detect fraud or loss; and
  6. contact you in any way (including mail, email, phone, visit, text or multimedia messages) about products and services offered by us and selected partners. We will only contact you in this way if you have previously indicated your consent. We may allow other people and organisations to use information we hold about you for the purpose of providing services you have asked for, as part of the process of selling one or more of our businesses, or if we have been legitimately asked to provide information for legal or regulatory purposes or as part of legal proceedings or prospective legal proceedings. From time to time, these other people and organisations may be outside the European Economic Area in countries that do not have the same standards of protection for personal data as the UK.We may monitor and record communications with you (including phone conversations and emails) for quality assurance, legal, compliance and training purposes. We will check your details with fraud prevention agencies. If you provide false or inaccurate information and we suspect fraud, we will record this.

We and other organisations may use and search these records to:

  1. help make decisions about credit and credit related services for you and members of your household;
  2. help make decisions on motor, household, credit, life and other insurance proposals and insurance claims for you and other members of your household;
  3. trace debtors, recover debt, prevent fraud, and to manage your accounts or insurance policies; and check your identity to prevent money laundering unless you give us other satisfactory proof of identity.

Special offers and discounts

Money off driving lessons offer

New customers booking lessons online for the first time only will receive a discount of 50p off the price of each one hour lesson. This offer is not available to customers wishing to purchase over the telephone.

Pupils may receive a discount of £2 off per hour when a course of 12 or more hours tuition is paid for together and in advance of the first lesson. Payment must be made via AA driving school, not direct to an AA franchised instructor. Offer is subject to withdrawal or change and cannot be combined with any other discount or offer.

Pupils in some postcode areas may receive an additional discount of £1 per hour when a course of between 2 and 11 hours of tuition is paid for together and in advance of the first lesson. Payment must be made via AA driving school, not direct to an AA-franchised instructor. Offer is subject to withdrawal or change and cannot be combined with any other discount or offer.

12 free driving lessons – prize draw

All pupils pre-registering for information about AA driving school before the 31 May 2008 will be entered into a prize draw to win one prize of 12 AA driving lessons. Winner will be sent vouchers for 12 driving lessons following the draw. Closing date for entry is 31 May 2008. No purchase necessary. Winner must take lessons before 31 December 2008 and must book their course of AA driving lessons by calling 0800 60 70 80. Subject to availability of instructor. No cash alternative and lessons are not transferable. AA driving instructors are self-employed franchisees and all contracts for the provision of tuition are between the pupil and the instructor.

This draw is not open to AA staff or members of their household or any agencies connected with this promotion. The winner's details will be available on 16 June 2008 by writing to the draw promoter at AA driving school, 15th Floor Castlemead, Lower Castle Street, Bristol BS1 3AG.

Discounts on MOT test, servicing and repairs

Offer is 33% off the MOT test (VOSA) fee, 15% off servicing (menu price) and 5% off all other work (excludes tyres, main dealer parts and any subcontracted work). AA members must show their membership card to be eligible for the offer. Discounts may not be used in conjunction with any other offer. No cash alternative or change given. We offer a price promise where we will not be beaten on price for the exact same goods or service within seven days of purchase and three miles of the centre.
