Terms and conditions

By booking a place on the Steer Clear Drink Drive Rehabilitation Scheme with us you agree to be bound by these terms and conditions.

Other service providers within the National Scheme may offer different terms ad conditions.

Terms and conditions

Definitions

You' – means you, the customer, the person this letter is addressed to.

'We' and 'Us' and 'Our' – refer to the DriverAware Division, AA DriveTech (trading name of DriveTech (UK) Limited).

'Scheme' – the Drink Drive Rehabilitation Scheme, the overall government approved process by which a court may make an order with your agreement, reducing the period of disqualification on satisfactory completion of an educational drink drive rehabilitation course and thereby reducing your driving ban.

'Course' – a Driver and Vehicle Standards Agency (DVSA) and Welsh Government approved drink drive rehabilitation course we run under the scheme. As specified by the DVSA, a course must include not less than 16 hours of group learning, and all Steer Clear courses are run over three 'sessions' delivered on three separate days.

'session' or 'course session' – a single session of group learning, and three sessions make up a course.

'course completion date' – the date the court referral gives by which you must complete your course. This is also known as the 'expiry date' or 'critical date'.

1.0 Booking your course

1.1 Booking  You must complete your course by the course completion date indicated on your court referral to the scheme. This date will be two months prior to the end of your reduced period of disqualification (assuming you complete the course). (Eg, for a 12 month ban, the reduced ban would be 9 months, so you must complete your course within 7 months of your sentencing.) This deadline cannot be extended under any circumstances.


1.2 Specific requirements  Please tell us at the time of booking about any specific requirements (for example impairment, disability and/or access issues or the need to take an interpreter) that you want us to consider so that we can make suitable arrangements. AA DriveTech will provide sign language interpreters at no extra charge, foreign language interpreters must be provided by you at your expense. We will not be held responsible for any special provisions if you do not tell us your requirements at the time of booking. Please note you must declare any outstanding motoring offences when booking. If you are caught driving during your ban you may not be eligible for the reduction in your disqualification. AA DriveTech Steer Clear cannot be held responsible for failure to get licence returned early.


1.3 Failure to book  If you fail to book a place in time to complete the course by the completion date in your referral, then you will be issued with a Notice of Non-Completion, and will not have the opportunity to reduce your driving ban.


1.4 Payment  You can pay using most debit and credit cards, or by cheque or postal order. We cannot accept future dated cheques. Your cheque should be made payable to 'DriveTech (UK) Limited'. If you pay by cheque or postal order we must receive your payment within 10 days of the date of booking to secure your place. If the first session of your course is less than 21 days from the date on which you made your booking, you must pay by debit or credit card. Once you have booked and paid for your course, your booking and payment is non-transferable and only refundable as set out in sections 2.0 and 3.0. We reserve the right to waive or refund any fees under these terms and conditions.


1.5 Cheques  You agree to pay an administration charge of £8.00 if your cheque is returned to us because you did not have enough money in your account. If this happens, we may cancel your booking. However, you may be able to reschedule your course in line with clause 2. You will have to make any further payments by debit or credit card. If you do not make the payment, you will not be able to do the course and you will be issued with a Notice of Non-Completion.


1.6 Instalments  You can choose to pay in up to three instalments. You must request payment by instalments at the time of booking. The minimum first instalment is one third of the full course fee or concessionary fee and this must be paid to secure a booking (All outstanding fees must be paid at least 14 days prior to your first session date). If you chose to pay by instalments and fail to clear all outstanding fees by this deadline then no refund of any payment(s) will be made and rescheduling fees will apply as per clause 2. If you clear all outstanding fees and fail to complete your course then normal terms apply regarding rescheduling and attendance, ie clause 2.3 or 2.4. If you cancel your course within 9 calendar days then clause 2.1 will apply.


1.7 Concessions  The concessionary course fee is payable by those in receipt of the following benefits: Jobseeker's allowance, Employment Support Allowance, Income Support, Pension Credits and Carers Allowance. Students in full time education are also eligible for the concessionary fee (if there are any disputes over eligibility, the HMRC definition of full time education will be used, see www.hmrc.gov.uk/manuals/ccmmanual/ccm18030.htm). Documentary evidence of eligibility at the time of booking will be required – the document used will need to be dated, and include the delegate's name, as well as evidencing the benefit received or educational status [Photocopies/scans will be acceptable]- For courses taken in London or Greater London the concessionary fee will only apply on weekday courses.

2.0 Rescheduling or cancelling part or all of your course booking

2.1 Cancelling  You can cancel or reschedule your course place free of charge within 9 calendar days of making your booking and payment with a full refund of any monies paid. Cancellation or transfer will be subject to the provisions in this section. AA DriveTech will supply the new provider with your referral details, but only after confirming that request with you for the protection of your confidential information.


2.2 Rescheduling or cancelling your booking more than 14 days before your course date  If you cancel and reschedule after 9 calendar days but more than 14 days before the first session of the course you may reschedule your course free of charge. However, if you cancel without rescheduling we will provide a refund of your course fee less a £30 cancellation charge upon application.


2.3 Rescheduling or cancelling your booking less than 14 days before your course date  If you wish to reschedule after 9 calendar days and less than 14 days before the first session date you will have to pay the full course fee again, unless you can show exceptional circumstances as per 3.3a. If you cancel after 9 calendar days and less than 14 days before the first session date you will not be entitled to any refund of fees paid.


2.4 Rescheduling a single session  You are strongly encouraged to attend all three course sessions of a single course. There may be exceptional circumstances when this does not happen. According to the DVSA policy, all sessions must be completed in sequence. If you miss the first session, you will need to rebook your whole course at an additional fee subject to availability. However, in exceptional circumstances it is recognised that you may need to miss one of the sessions of your course, and wish to book a replacement session on another course. You may do so, subject to availability of a suitable session before your completion date, but bearing in mind that your course needs to be done in sequence. A single session fee is one third of the course fee or concessionary fee where applicable. The rebooked course session must not be more than 8 weeks after your last session. If the lapse is longer than 8 weeks the whole course must be rebooked at the full fee or concessionary fee where applicable.

3.0 Attending or completing your course

3.1 Completion date  You must complete your course, (all three sessions), by the completion date. If you cannot complete your course by this deadline, you will be issued with a Notice of Non-Completion and you will not be able to secure a reduction in the length of your driving ban.


3.2 Completing the course  You must satisfactorily complete the course. This involves arriving on time, being present for the whole session and fully taking part for the duration of all three sessions. The trainer will decide if you have completed the course. You must switch off any mobile communication devices during all three sessions. When you go on the course you cannot take anyone else with you (unless it is necessary in order to meet a special requirement as per clause 1.2 or as otherwise agreed beforehand with us), or take pets as there are no facilities to accommodate them at the training venues.


3.3 Failure to attend
3.3a Exceptional circumstances  For example bereavement, medical reasons or you are a parent or carer and your dependant is taken ill, you will be able to reschedule your course/sessions in accordance with section 2.


3.3b Any other reason  You may book a replacement session on another course, if one is available, at the additional fee. A single session fee is one third of the course fee or concessionary fee where applicable.

3.4 Failure to complete
You will fail to complete your course if:

3.4a you arrive late  You will not be allowed on to the session if you are late. You may reschedule the session to which you arrive late, subject to the provisions of 2 above. You will be eligible for a refund of the rescheduled single session fee if you are able to provide evidence that the delay has been caused through major disruption to the local public transport or road network, for example a major incident resulting in tube, train or road closures. You are expected to leave enough time for your journey allowing for general delays. You must complete all three sessions in sequence to be issued with a Certificate of Completion.

3.4b you fail to provide the correct personal identification  When you attend your course, you must provide satisfactory proof of your identity. Acceptable documents are: a National Insurance card, passport or birth certificate. If you cannot produce any of these you may provide two utility bills or other official documents with your name and address. If you fail to establish your identity satisfactorily over the duration of the course you will not be issued a Certificate of Completion. You may reschedule the course to which you fail to provide the correct personal identification subject to the provisions of 2.4 above.

3.4c you are under the influence of drink or drugs  If in the opinion of the trainer you are under the influence of drink or drugs at any stage of your course sessions, you will not be allowed entry or re-entry on to the session. You will not be able to reschedule the session or rebook another course. We will not refund the original course fees and you will be issued with a Notice of Non-Completion.

3.4d you are abusive, disruptive failure or fail to take part fully  If in the opinion of the trainer you are abusive or disruptive, we will ask you to leave the session. In such circumstances AA DriveTech reserve the right to refuse you re-admittance to any course session and you will not be eligible for a refund of any part of the course fees. You will be issued with a Notice of Non-Completion.

3.4e you are suspected of driving to the course venue  If the trainer has reason to believe that you have driven to the session venue, the trainer is legally bound to report this suspicion, and any corroborative evidence to the police. Under such circumstances the police may investigate, and subsequently charge you with the offence of driving while disqualified. In such circumstances we reserve the right to refuse you admittance to any course session and you will not be eligible for a refund of any part of the course fees. You will be issued with a Notice of Non-Completion.

4.0 If we cancel the course and reschedule

If we cannot deliver your course for any reason, we will make every effort to contact you via text or email message advising you of any disruption or cancellation. You must contact us within 7 days to reschedule your course in this event. You will not have to pay any extra charge. If you do not wish to reschedule your course then we will provide a full refund and issue you with a Notice of Non-Completion within two weeks of your critical date as per section 7.0.

5.0 Liability

We will not be liable under these terms and conditions for any loss or damage caused by us, our employees or agents in circumstances where:

i) There is no breach of a legal duty of care owed to you by us or by any of our employees or agents; and
ii) Such loss or damage is not a reasonably foreseeable result of any such breach.

We shall also not be liable for any increase in loss or damage resulting from breach by you of any term of this contract. Nothing in this contract of sale will affect your statutory rights or in any way exclude or limit our liability to you for death or personal injury resulting from our negligence.

6.0 Data sharing

AA DriveTech delivers the Steer Clear Course in partnership with the London Community Rehabilitation Company (LCRC). By booking a Steer Clear Course you agree to the sharing of the data you supply between AA DriveTech and LCRC, on the understanding that the use of this data will be strictly limited to the provision of the Steer Clear Course.

7.0 Certificates of Completion or Non-Completion

If you do not complete a course by your course completion date, you will be issued a Notice of Non-Completion within 2 weeks of that date. When you complete your course you will be issued with a Certificate of Completion. The original will be sent to the court that referred you within 2 weeks of your completion date. If you require a replacement certificate for any reason at a later date, one will be issued on request for a fee of £15.00.
